The Law

The acquisition, possession, distribution, procurement, production, manufacture, import, and export of most psychoactive substances, as well as advertising for them, are criminal offenses. This applies regardless of the method of procurement (i.e., substances acquired online can also fall under the Narcotics Act). Information on the Narcotics Act can be found at know-drugs.ch.

If you buy, possess, or consume these substances, the police can report you – even for small amounts! Purchasing substances online carries a particularly high risk of legal trouble, as the supposed anonymity ends when you have the ordered substances delivered to your address. For cannabis, there is a special regulation for small quantities and adults; for amounts up to 9.9 grams, a fine is issued without charges.

Despite breaking the law, you have rights.

  • During identity checks, it is sufficient to provide your surname, first name, date of birth, place of residence, place of origin, and occupation. You do not need to provide any information about your job, income, criminal record, or other personal circumstances.

  • Without identification, you can be detained for up to 24 hours until your identity has been verified.

  • If arrested, you have the right to refuse to make any further statements to avoid incriminating yourself. If questioned, consult a lawyer – you have a right to one. Upon arrest, the officers must inform you of the crime you are accused of.
